1. Acceptance of Terms

By accessing or using EnsureFix ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

EnsureFix is an AI-powered platform that assists software development teams by automatically analyzing tickets, generating code fixes, creating pull requests, and reviewing code changes. The Service uses third-party AI models (including Anthropic's Claude) to process your code and ticket data. The Service connects to your existing version control systems and ticket providers.

3. Your Account

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • One person may not maintain multiple accounts.
  • You are responsible for all activity under your account.
  • Organization administrators are responsible for managing member access and permissions.
  • Notify us immediately if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to generate code that violates applicable laws.
  • Attempt to reverse-engineer, decompile, or extract the AI models or platform algorithms.
  • Exceed the usage limits of your plan without authorization.
  • Share account credentials with unauthorized parties.
  • Submit malware, malicious code, or harmful content through the Service.
  • Use the Service in any way that could impair its performance or interfere with other users.
  • Attempt to bypass security measures, rate limits, or access controls.

5. Your Code and Data

  • Ownership: you retain all intellectual property rights to your source code, repositories, and data. We do not claim ownership over any content you provide or that is generated on your behalf.
  • License to us: you grant EnsureFix a limited license to process your code and data solely for the purpose of providing the Service.
  • Responsibility: you are responsible for ensuring that connected repositories do not contain secrets, credentials, or content that should not be transmitted to third-party AI providers.

6. AI-Generated Code

  • No guarantee of correctness:AI-generated code, plans, and suggestions are provided "as is". While we implement multiple validation layers (security scanning, code review, confidence scoring), you are responsible for reviewing and testing all AI-generated output before deploying to production.
  • Human review required: EnsureFix is designed as an assistive tool, not a replacement for human code review. All generated code should be reviewed by a qualified developer.
  • Third-party AI processing:your code and ticket data are transmitted to Anthropic's Claude API for processing. Anthropic does not use API-submitted data to train its models. See our Privacy Policy for details.
  • Code ownership: you retain full ownership of any code modifications generated by the Service.

7. Payment and Billing

  • Paid plans are billed monthly or annually via Stripe as selected.
  • Usage-based billing (token metering) is calculated based on AI tokens consumed during processing.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice.
  • Refunds are handled on a case-by-case basis.
  • Failure to pay may result in suspension of your account.

8. Intellectual Property

  • Your code: you retain all rights to your source code, repositories, and data.
  • Our platform: the EnsureFix platform, including its UI, algorithms, documentation, and branding, is our proprietary property protected by intellectual property laws.
  • Feedback: if you provide suggestions or feedback about the Service, we may use it to improve the platform without obligation to you.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED CODE WILL BE ERROR-FREE, SECURE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENSUREFIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR DAMAGES RESULTING FROM AI-GENERATED CODE DEPLOYED WITHOUT ADEQUATE HUMAN REVIEW.

11. Indemnification

You agree to indemnify and hold harmless EnsureFix and its affiliates from any claims, damages, or expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) deployment of AI-generated code without adequate review; or (d) your violation of any third party's rights.

12. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted access.
  • Scheduled maintenance will be communicated in advance when possible.
  • We are not liable for downtime caused by third-party dependencies (AI providers, VCS platforms, payment processors).
  • We reserve the right to modify or discontinue features with reasonable notice.

13. Termination

  • You may close your account at any time by contacting support.
  • We may suspend or terminate accounts that violate these Terms.
  • Upon termination, your data will be deleted in accordance with our Privacy Policy retention schedule.
  • Provisions that by their nature should survive termination (liability, indemnification, IP) will survive.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware.

15. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated terms.
